Deportation Is Possible, But You Can Fight It

Blog

A chance to come to America and take advantage of the American Dream is one that should not be understated, as it is full of opportunity. However, because this opportunity is so vast, the federal government has strict measures in place to make sure that those who come to the country are law-abiding citizens. When this agreement is not fulfilled, deportation is an option.

Expired Visa

When a person comes to America on a visa, they are given clear instructions on the expiration of the visa. It is then the duty of the individual to report in and request an extension. If these steps are not followed, the visa will expire, and the individual will likely be required to return to their home country.

Unfortunately, sometimes, an individual will apply for an extension, but their paperwork will get lost for one reason or another. As a result, the visa expires. In these instances, an attorney can work with you to prove that you did follow the appropriate steps to extend your visa and work to ensure you are allowed to stay within the country.

Fraudulent Marriage

A common way that people make their way to America is by way of marriage. The law upholds this path to citizenship, but only when the marriage is authentic, not fraudulent. If the government suspects that two people got married solely for the purpose of citizenship, the government can deem the marriage fraudulent, revoke citizenship, and initiate the deportation process. An example of this scenario might be someone who pays an American citizen for marriage.

If you are suspected of this crime, and you know your marriage is valid, you do not have to panic. The burden of proof rests on the government, so it is up to them to prove that your marriage is not valid. It is not your responsibility to do so.

Fighting a Deportation

Depending on the scenario, it is possible to fight deportation. However, any success in this battle is easier to achieve if you have an attorney fighting on your behalf. If you or a loved one is at risk of deportation, it is critical you speak with an attorney as soon as you can to protect yourself.

The above represent just some of the scenarios that can result in deportation. Make sure you stay informed and abide by the law to protect your right to stay in the country.

help for families going through immigration issues

My son has been best friends with a little boy from up the street for about two years. When his family came to me and told me that they may be leaving because of immigration issues, my heart broke. Those two boys spend so much time together and I knew that my son and his friend would be scarred for life if they were separated like that. I told the family that I would do some digging and talk with an immigration attorney friend of mine and see what I could find out. This blog was created to help this family as well as any others going through immigration struggles.
